1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the services, website, and facilities provided by *Hillshire International College* (“the College”). By enrolling in the College, accessing its services, or using its website, you agree to comply with these Terms.  

If you do not agree with any part of these Terms, you should refrain from using the College’s services or website.

2. Eligibility

Hillshire International College provides education and training services to individuals who meet the eligibility criteria for enrolment, including:

– Providing accurate and complete information during the application process.

– Meeting the requirements under applicable laws for international students (where applicable).

– Compliance with the College’s policies and procedures.

3. Enrollment and Fees
1. Enrollment Process: 

   Enrolment is subject to the College’s approval after submission of required documentation and payment of fees. Enrolment details and conditions will be outlined in the Letter of Offer and Student Agreement.

2. Fees and Payment:  

   – Tuition fees and other charges are outlined in the Student Agreement.  

   – Fees must be paid by the due date to maintain enrollment.  

   – Failure to pay fees on time may result in suspension or cancellation of enrolment.

3. Refund Policy: 

   The refund policy is governed by the Education Services for Overseas Students (ESOS) Act 2000 and the College’s specific refund policy, available on request or on our website.

4. Code of Conduct

All students, staff, and visitors are expected to adhere to the College’s Code of Conduct which promotes respect, professionalism, and a safe learning environment. Prohibited behaviors include:

– Harassment, discrimination, or bullying.

– Academic dishonesty (e.g., plagiarism, cheating).

– Any behavior that disrupts the learning environment or violates Australian laws.

Breaches of the Code of Conduct may result in disciplinary action, including suspension or termination of enrolment.

5. Academic Requirements
1. Attendance and Participation:

   Students are required to maintain attendance levels and actively participate in all scheduled classes, training sessions, and assessments.  

   – International students must comply with attendance and academic progress requirements under their visa conditions.

2. Assessment and Certification: 

   – Students must complete all required assessments to receive certification.  

   – Certificates and transcripts will only be issued upon successful completion of all course requirements and payment of all fees.

6. Intellectual Property

All course materials, resources, and content provided by the College are protected by copyright and remain the intellectual property of Hillshire International College.  

– Students may use materials for personal study purposes only.  

– Reproduction, distribution, or sharing of materials without permission is strictly prohibited.

7. Privacy and Data Protection

Hillshire International College collects, uses, and stores personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and other applicable privacy laws.

– By enrolling, you consent to the collection and use of your information for purposes such as enrolment processing, compliance reporting, and student support.

8. Limitation of Liability

Hillshire International College will not be held liable for:

– Any loss, damage, or injury caused by circumstances beyond the College’s control (e.g., natural disasters, third-party services).  

– Indirect or consequential damages arising from the use of its services or facilities.

Students are responsible for securing appropriate insurance, including health insurance (for international students as required by law).

9. Withdrawal, Suspension, and Termination
1. Withdrawal by the Student:  

   Students wishing to withdraw must submit a formal request in writing to the College. The refund of fees will be subject to the Refund Policy.

2. Suspension or Termination by the College:  

   The College reserves the right to suspend or terminate enrolment in cases of:

   – Non-payment of fees.

   – Breach of the Code of Conduct or visa conditions.

   – Academic or attendance performance issues.

3. Appeals and Complaints: 

   Students have the right to appeal decisions or lodge complaints in accordance with the College’s Complaints and Appeals Policy.

10. Third Party Services

The College may engage third-party providers for services such as payment processing, IT support, or educational delivery. While we take reasonable steps to ensure their compliance with relevant laws and standards, the College is not responsible for actions or policies of third-party providers.

11. Changes to Courses and Terms

Hillshire International College reserves the right to:

– Modify course content, delivery methods, or schedules to maintain compliance with regulatory requirements.

– Update these Terms at any time, with changes effective immediately upon publication.

Students will be notified of material changes to their course or these Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any disputes arising from these Terms will be subject to the jurisdiction of Australian courts.
